General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting for purposes relating to a trade, business, or profession and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: an agreement concluded within the framework of an organized system for distance sales of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.
Means of distance communication: any method that can be used for concluding a contract without the consumer and entrepreneur being physically present in the same place at the same time.
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the entrepreneur’s premises and will be sent free of charge at the consumer’s request.
If the contract is concluded electronically, the terms may be made available electronically in such a way that they can be easily stored on a durable medium.
If specific product or service conditions apply in addition to these terms, the consumer may always rely on the provision that is most favorable to them in case of conflicting terms.
If one or more provisions are void or annulled, the remaining provisions remain in force and the invalid provision will be replaced with one that most closely reflects its original intent.
Situations not covered shall be assessed in accordance with the spirit of these terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur may amend or adjust the offer.
The offer contains a complete and accurate description of the products and/or services. Images are a truthful representation but minor differences in color or appearance may occur.
Obvious mistakes or errors do not bind the entrepreneur.
Each offer includes sufficient information regarding:

Any shipping costs

The manner in which the contract will be concluded

Whether the right of withdrawal applies

Payment, delivery, and execution methods

Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and fulfills the stated conditions.
Electronic acceptance will be confirmed without delay. Until confirmation is received, the consumer may dissolve the contract.
The entrepreneur will take appropriate technical and organizational security measures for electronic transactions.
The entrepreneur may investigate whether the consumer can meet payment obligations and may refuse an order with proper justification.
The entrepreneur will provide the consumer with:

Information regarding the right of withdrawal

Warranty and after-sales information

Termination requirements for long-term contracts
Every contract is subject to product availability.
Article 6 – Right of Withdrawal
The consumer may withdraw from the contract within 14 days without giving any reason. The period starts the day after receipt of the product.
The product may only be handled to the extent necessary to assess it. If withdrawn, it must be returned in original condition and packaging where reasonably possible.
The consumer must notify the entrepreneur within 14 days and return the product within 14 days thereafter.
Failure to do so results in the purchase becoming final.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be made within 14 days after withdrawal notification, provided the product has been received or proof of return is provided.
Article 8 – Exclusion of Right of Withdrawal
Exclusion applies to products:

Made to consumer specifications

Clearly personal in nature
-
That cannot be returned
-
That deteriorate rapidly
-
Subject to financial market fluctuations
-
Newspapers and magazines
-
Sealed audio/video/software if opened
-
Sealed hygienic products if opened
Exclusion also applies to certain services, including accommodation, leisure activities on fixed dates, and betting.
Restocking Fee
A restocking fee of up to 15% may be charged and deducted from the refund.
Returns may be refused if products are damaged, used beyond inspection purposes, or not in original packaging.
Article 9 – Price
Prices remain unchanged during the validity period unless VAT rates change.
Import VAT and customs clearance costs may be charged by postal or courier services if goods are shipped from outside the EU.
Printing and typographical errors are not binding.
Article 10 – Conformity and Warranty
Products must comply with the agreement and applicable legal standards.
Warranty does not affect statutory consumer rights.
Defects must be reported within 14 days of delivery.
Warranty does not apply if:

The consumer modified or repaired the product

Products were exposed to abnormal conditions

Damage results from government regulations
Article 11 – Delivery and Execution
Orders will be executed within 30 days unless otherwise agreed.
If delivery is delayed beyond 30 days, the consumer may cancel the contract free of charge.
Risk of damage or loss remains with the entrepreneur until delivery.
Article 12 – Long-Term Transactions
Consumers may terminate indefinite agreements at any time with a notice period of one month.
Fixed-term agreements may not be automatically extended unless legally permitted.
After one year, agreements exceeding one year may be terminated with one month’s notice.
Article 13 – Payment
Payment must be made within 7 working days unless otherwise agreed.
The consumer must report incorrect payment details immediately.
In case of non-payment, reasonable costs may be charged.
Article 14 – Complaints
Complaints must be submitted within 7 days of discovery.
Complaints will be answered within 14 days.
If unresolved, a dispute arises subject to dispute resolution.
Article 15 – Disputes
Dutch law exclusively applies to agreements between the entrepreneur and the consumer.
